Wait...so they just took Eric's photo without permission (it seems) and are publishing it nationwide without credit to Eric? Or did they include credit where credit belongs? I take it since it's relay for life they're not going to pay Eric, right?

Is this regarding the runners crossing right in front (and I do mean *right* in front) of a CP autorack train coming around the wye in Plymouth? Yikes! That would have been interesting video to see.
Generally speaking, if someone uses your picture without permission, you can still get them to pay. I used to do a lot of sports play-by-play for public access with (then) Metrovision in Livonia back in the 1980s. I of course did it all as a volunteer, and nobody made any money off of it. One day I was watching the local cable TV and Metrovision had used some of my hockey play by play ("He scoooooooooooorrrrrrrrrreeeeeesssss!!!!") as a background to a local commercial they made for a local sporting goods company. I started taping the local commercials that came on in the programming, and when I had caught that particular commercial on tape, I went to Metrovision and demanded the standard "talent fee" (which was $25 then) for them using my voice without my permission. They said they would just put new audio in the commercial. Then I showed them the tape, and they knew they had to pay up, and they did, as they knew if I took it to court the would have to pay far more. I didn't mind putting local sports on TV for free, but if someone else was going to make a dime off of it, I wanted at least a penny of that dime!

Let me set this whole thing straight, it was one of those chain emails, a person was browsing on RRPics and saw it so he emaild the link to a friend and now I got it after almost 500 people. I get these all the time. I have shared them with people like the ones with the first painted Pan Am units.

To be 100% honest no. I got almost all of it off ebay I give credit when I can but almost everything is blank. Now there are a few pictures that my dad took in Wayne when he worked down there. I took my first train picture in Montana back in the 80's then got back in 2003 and really took off 2005. I bought the pictures really to share them I am not going to start mass printing and selling business.

As far as the CP train picture I'm glad someone could use it for something as it clearing isn't an award winning shot.

I wonder how many people would actually care if he or his father took the picture. It's his dad's picture, sp it's not like he's stealing it from someone else he doesn't know. In this particular case it seems like a whole bunch of nothing . Maybe I'd feel differently if it were my pictures being posted without my approval or without the credit.I guess stuff like that doesn't seem very important to me, certainly not something to get all up in arms about.
